Are Mixpanel and Amplitude HIPAA Compliant? (Product Analytics for Health Apps)

Both can be operated HIPAA-compliantly — and this is the key contrast with Google Analytics: Mixpanel and Amplitude will sign BAAs on qualifying plans, so a lawful path exists. But "the vendor signs BAAs" is where compliance starts, not where it ends. A BAA-covered Mixpanel project with sloppy event design leaks health information just as effectively as an uncovered one; it's just better paperwork around the same problem.

For telehealth and digital-health product teams, this question matters more than the web-pixel ones — your product usage data is intrinsically health data. Every screen view in a therapy app says something about the user's health.

The conditions that make it actually compliant

  1. The BAA, on the right plan. Both vendors gate BAAs to specific tiers — confirm yours qualifies and the agreement is countersigned before a single PHI-adjacent event flows. A free-tier project someone spun up in 2024 has no coverage.
  2. Event design as a compliance discipline. Event names, properties, and user profiles should carry the minimum needed to answer product questions: "assessment_completed" not "depression_assessment_completed_score_18"; internal user IDs, not emails, as the join key; no free-text fields (they will eventually contain something a user typed about their health).
  3. Access controls and retention treated like any PHI system: role-based access, audit trails, deliberate retention windows.
  4. The downstream problem — the one that actually catches teams. Product analytics platforms love to integrate: cohort syncs to ad platforms, exports to warehouses, session-stitching with marketing tools. Every integration is a boundary crossing. A BAA-covered Amplitude project syncing "high-intent users who viewed treatment screens" to Meta as a custom audience has laundered PHI into an ad platform — with dashboards, so it's easy to prove.

For compliance purposes they're closer than their sales decks suggest: both offer BAAs, both give you the event-design rope to hang yourself, both have the integration surface that needs governance. Choose on product-analytics merits; comply through implementation. (If you want analytics where the data never leaves your infrastructure, self-hostable options like PostHog are the other lane.)

Is Mixpanel HIPAA compliant on the free plan? No — BAA availability is tied to qualifying paid plans. No BAA, no PHI, regardless of how carefully you instrument.

Can we sync analytics cohorts to ad platforms for retargeting? Not cohorts defined by health-revealing behavior. This is one of the highest-risk flows in digital health: it converts product PHI into ad-platform audience data. Marketing activation needs consented, scrubbed, server-side pathways instead.

Do we need this if we already have compliant web analytics? They're different layers — web/marketing analytics (Piwik PRO, Freshpaint, et al.) versus in-product behavioral analytics. Most digital-health companies need both, governed by the same principles.
