HIPAA Tracking · Playbook

How to Track Marketing for a Mental Health or Behavioral Health Startup

Last updated: August 10, 2026 ยท By Jason Garrett, Founder, Coast Studio. Not legal advice — review your setup with healthcare counsel. Full legal landscape: The State of HIPAA Tracking.

Behavioral health is the most sensitive category in health marketing and the most restricted on every platform, so it demands the strictest build. A person visiting a page about depression, addiction, or an eating disorder is disclosing a diagnosis by the visit alone. Cerebral's FTC settlement is the cautionary tale; the way you measure has to assume that sensitivity from the first tag.

Assume the strictest posture

Meta places mental health, addiction, and reproductive health in its tightest restriction tier, where most conversion events are blocked. Regulators and plaintiff firms watch the category closely. Treat every page and event as if it names a diagnosis, because effectively it does.

The build

  1. No client-side pixel anywhere near clinical content. Go pure server-side and strip everything but a neutral event.
  2. Radically neutral taxonomy. signup_started, never anything naming a condition or program.
  3. No audiences from clinical behavior. No retargeting from condition pages, no lookalikes from patient or intake data. Target broad; let creative qualify.
  4. Consent-gate everything, to the MHMDA opt-in standard, given how many behavioral-health users are in protected states.
  5. Keep intake fully tag-free. Assessments and screeners are the most sensitive data you hold.

Measure with experiments, not surveillance

With clinical audiences off the table, geo-lift experiments and first-party attribution do the heavy lifting. "How did you hear about us?" at signup is crude and durable. A geo holdout tells you incremental signups with no user-level data leaving your walls — the only honest read in a category this sensitive.

Creative in a sensitive category

Lead with hope and access, not the condition: "Talk to someone this week." Keep diagnoses out of copy and testimonials. Platform review is unforgiving here, and so is the regulator.

FAQ

Can we ever use Meta or Google for behavioral health? Yes, with the strict build above. Plenty of behavioral-health companies advertise compliantly; they just don't run the standard setup.

Is self-reported attribution really good enough? For a category where user-level tracking is radioactive, self-reported plus geo experiments is more defensible and often more accurate than platform attribution.

What about crisis-related keywords? Handle with extra care and platform-specific rules; some are restricted outright. Route sensitive intent to resources, and keep tags off those flows.
